SHADE TREE – AGREEMENT/LIABILITY RELEASE
I, the undersigned, agree that any and all trees that are received through the PG&E Shade Tree pilot program are my trees and not the responsibility or property of PG&E. I understand that I will care for the tree and be fully liable for any damage to person or property which may be caused by the planting, maintenance and presence of the tree, or is any way related to my receipt of the tree under the program. I further agree to indemnify and hold harmless PG&E, its officers, employees and agents from any damages related to the trees I receive through the Program.
I further certify that I am the legal owner and resident of the property listed on the Application and that this Agreement and Release applies to me and to my successors in interest, and shall run with the land.
I also agree to the following terms and conditions:
- Tree will be planted at my PG&E service address indicated on the Application.
- I agree to plant the tree within two weeks of receipt of the tree in the location designated on the Application.
- I agree to Contact Underground Service Alert at 811 before planting to insure safe digging while planting my tree.
- I will not plant my tree under power lines, at the base of a power poles or within 6 feet of a pad mounted transformer.
- I will avoid planting in a site location that would interfere with satellite dishes, chimneys and solar panels on my home or my neighbors’ homes.
- I will not plant the tree closer than 15 feet to my home to allow for fire safety.
- I agree to plant the tree on the W,E or S at the distance from the house as noted on the Application.
- I agree to provide the tree care of watering, weeding, and pruning to ensure the growth of a healthy tree.
- I understand that I will receive tree care instructions and guidelines for watering weeding and pruning.
- I agree to grant access to PG&E or its representatives to my property for random tree inspections up to one year after the tree is planted.
